Provisional Powers Committee, consisting of such
persons as a Secretary of State shall from time to time appoint, and who shall hold office on such terms as a Secretary of State may determine.
(2) One of the members shall be appointed by the Secretary of State to be Chairman of the Committee.
In the absence of the Chairman from any meeting of the Committee the members present shall appoint one of
the members to act as Chairman of that meeting.
(3)
The powers of the Committee may be exercised at a meeting at which two or more members are present. 3.
Notwithstanding anything contained in the Ordinance and the Statutes, the Committee shall have power, subject to Sections 4 and 5 of this Order to exercise the powers of the Council given under Section 9, subsection (3) of the Ordinance to administer the property and manage the affairs of the University including:- (a) the powers given under sub-paragraph (1) of
Statute 12 to govern, manage and regulate
the finances of the University in so far as the same consists of the funds now or hereafter standing to the credit of the University at the Hong Kong and Shanghai Banking Corporation;
(b) the powers given under sub-paragraph (5) of the
same Statute to borrow money on behalf of the University with the modifications that:-
(1) Such powers may be exercised without the
approval of the Court.
(2)
It shall not be necessary for the Committee to obtain the sanction of a resolution of the Council as prescribed in the said sub-paragraph of the Statute before borrowing in excess of one hundred thousand dollars;
(c) The powers given under sub-paragraph (6) of the same Statute to enter into, vary, carry out and cancel
/contracts
